The first stage when transferring a house through solicitors or licenced conveyancers is when the sale of the property is agreed. The sellers solicitors or licenced conveyancer obtains the title deeds and arranges for the seller to fill in some enquiry forms. The conveyancing solicitors then prepare a contract and sends this out with a legal information pack. The solicitors then answer enquiries from the buyers solicitors and arrange the moving date. The date to move is then set. Any extra money and legal info are sent from the sellers solicitors. If you are just selling or there is a surplus due back to you after the completion of your sale and purchase your solicitor will always try to send the money to you on the day of completion or, at the very latest on the next working day.

After the first stage comes the exchanging of contracts. This consists of the licenced conveyancer receiveing the buyers' deposit and obtaining a settlement figure for any mortgage on the property. They then approve the transfer deed and arrange for the seller to sign it. The buyers solicitors send the buyers contract and deposit to the sellers' solicitors and prepare the transfer and mortgage deed for the buyer to sign. They arrange final searches and prepare final accounts and request any monies required for completion.

The third stage is completion when the sellers solicitors receive the balance of the purchase price and pay off any mortgages on the property. They hand over the title deeds and send the seller the balance or use this towards the purchase of another UK property (if any). Meanwhile the buyers solicitors send the balance to the sellers solicitors or licenced conveyancer and collect the deeds to the property. They pay stamp duty (if any), register the purchase at HM Land Registry and then send the title deeds to the Bank or Building Society.
